Proposed amendments to the Code of the City of Fairfax, Chapter 110 (Zoning) – Accessory Dwelling Unit Occupancy, Reducing Special Use Permits, and Miscellaneous Amendments
2:40ForemanstaffSo first up, we'll discuss the potential ADU accessory dwelling unit occupancy amendments. And as I had mentioned in May, staff has been asked to examine ADU standards in total. And that would include some big topics, would include things like physical characteristics of accessory dwelling units or where and how they're permitted. But there's also some existing standards on ADU occupancy, and that particular topic is reasonable to address separately from the bigger issue. And the reason is it's a relatively minor regulatory change. What's being proposed here does not involve changing the physical standards of ADUs. So this particular amendment, it's limited to removing what some folks consider to be an outdated regulatory hurdle for ADU occupancy.
And I know we've been over this before, but just in the context of this discussion, I think it's helpful to quickly go over again just what is an accessory dwelling unit. The zoning ordinance definition is right here in the box. In everyday terms, the definition says that an accessory dwelling unit is basically a full dwelling unit that's part of another house, and it's subordinate to or accessory to the main house, meaning that the ADU is significantly smaller than the main house. Now, aside from this definition here, there are also use standards. The use standards appear in Section 355, and they set standards for accessory dwelling units, and these include a number of physical standards, so things like measurements,
This zoning change as far as the age and disability? No, we wouldn't, although the number of accessory dwelling units is relatively small anyway, and we don't track proactively who it is who lives in each one. So it's something that would be a little bit difficult to measure.
